All electoral offices in Buzăƒu county were abolished even before the start of the electoral campaign

The High Court of Cassation and Justice abolished, by a final decision, all electoral offices in Buzăƒu County, a few hours before the start of the electoral campaign. The authorities are waiting for clarifications from the Central Electoral Bureau to know if they can organize a new drawing of lots for the designation of presidents and residents of the electoral offices in the county.

Update 19.55 The Buzăƒu Court announced that it will organize, on Friday, a new drawing of lots for the appointment of the presidents and residents of the electoral offices in the county.

†In accordance with sentence no. 209/24.04.2024 pronounced by the Ploiești Court of Appeal in file no. 407/42/2024, definitively by decision no. 2500/09.05.2024 of the High Court of Cassation and Justice, we inform the public that on May 10, 2025, at 3:00 p.m., at the headquarters of the Buzăƒu Court, the draw will take place i with a view to appointing the presidents and residents of the constituency electoral offices, in accordance with the provisions of art. 26 paragraph (5) of Law 115/2015 for the election of local public administration authorities’, it is shown in the announcement of the Buzăƒu Court.

Initial letter

The second drawing of lots for the presidents and residents of the electoral offices in Buzăƒu County was cancelled. Thus, after the first draw was annulled by the Central Electoral Bureau, the second draw was challenged in court, being annulled in the first phase by the judges of the Court of Appeal Ploiești, and on Thursday, the High Court of Cassation and Justice rejected the appeal filed by the Central Electoral Bureau against the decision of the Ploiești Court of Appeal, thus the decision remains final.

Thus, all electoral offices in Buzăƒu county are abolished, a few hours before the start of the electoral campaign.

†Accepts the appeal. Orders the annulment of BEC Decision No. 37 /H/21.04.2024. Admits the appeal of 19.04.2024 against the minutes no. 2120/A/2024 of 18.04.2024 drawn up by the President of the Buzăƒu Court and the drawing of lots procedure for the appointment of the President of the constituency electoral office and of its resident made by the President of the Buzăƒu Court on 18.04.2024, at 19.00, with the consequence of the complete cancellation of the drawing of lots procedure and the subsequent documents drawn up and its resumption, with compliance with disp. art 26 paragraph 5) of Law no. 115/2015, decided on April 24, the Ploieśti Court of Appeal.

This decision was upheld, on Thursday, by the magistrates of the CCJ.

Thus, the Buzoian authorities are now waiting for clear indications from the Central Electoral Office to know if they can organize a new draw for the appointment of presidents and residents of the electoral offices in the county and their reconstitution or they have to wait, according to the law, two more days.

“We are waiting for clarifications from the BEC, there are several things to clarify and the most important thing to clarify is what is most imperative to respect at this moment and how far one can go in the spirit of the law, for that we are analyzing compliance with the 48 hours. The law states that the draw must be announced at least 48 days before it takes place. Basically, we are waiting for BEC to clarify what is most important, to hold the draw only 48 hours after we announce it or to organize it as soon as possible”, explained the Prefect of Buzăƒu County, Daniel Å the stick

Also, the prefect of the county conveyed that the court’s decision has no effect on the lists of candidates, which are final.

“It is important that in such moments we maintain our balance and calmness. I haven’t heard anyone in the BEJ that there could be a hypothesis of not holding the elections. The final candidacies remain. Regarding the calendar, at this moment we have passed the stage where the candidacies have remained definitive, today (Thursday – no) would be the deadline for completing the Electoral Office of the Circumscription, both county and t and locally, in the third stage where there are still places left to be filled with representatives of parties or non-parliamentary formations or independents, and what else needs to be done in the following period, with a deadline of May 11 , 23:59, to establish the order on the ballot. These are the operations that are on the calendar and that are part of the decision that will be made these days, said Daniel Åiclea.
